Wrongful death suit filed by East Dubuque family

EAST DUBUQUE, Ill. -- An East Dubuque family wants more than $50,000 for the death of their wife and mother.

Tabitha Carroll, 32, died on Oct. 31 after a semi-tractor trailer loaded with corn pinned the family’s truck against an Illinois Department of Transportation vehicle. Authorities transported both Carroll’s husband, Randy, 38, and their son, Gabriel, 3, to the hospital with serious injuries.

On Friday, Chicago attorney John Perconti filed a wrongful death suit and two personal injury claims with the Kane County Courthouse in Geneva. The accident happened in Kane County, on an overpass bridge in Huntley, between Chicago and Rockford.

The suit alleges that the semi’s driver, Jeffrey Repec, 30, of Spring Grove, acted negligently and recklessly. Police determined Repec was under the influence of marijuana when driving. The suit also lists Repec’s employer, Geils Farms in Harvard as a defendant. Accident investigators discovered five of the 10 brakes on the semitrailers were “inadequate.”
