Clayton deputy followed procedure
Prairie du Chien Police Department investigates October shooting.

LUANA, Iowa -- A deputy with the Clayton County Sheriff's Department followed the correct protocol during a duty-related shooting in October, according to an independent investigation.

Waylin L. Buerger, 35, of Luana, was arrested on Oct. 25 after leading authorities on a high-speed chase between Monona and Luana.

The Prairie du Chien (Wis.) Police Department, which conducted the investigation, concluded that Reserve Deputy Mary Bissell acted "in accordance with the policies and procedures of the Clayton County Sheriff's Department" during the incident.

According to a criminal complaint, Buerger led Bissell on a high-speed chase around 12:15 a.m. Buerger failed to stop at several stop signs in Monona and reached speeds of 90 mph.

Buerger eventually pulled his vehicle to the side of the road in Luana, exited and proceeded to ram his shoulder "multiple" times into Bissell.

Bissell drew her weapon, but Buerger continued after her. The deputy shot Buerger and held him down on the ground until back-up arrived.

Buerger resisted arrest and refused to consent to a blood-alcohol test.

Bissell and Buerger were taken to Central Community Hospital in Elkader with serious injuries. The report did not include the nature of the injuries. Both were treated and released.

Buerger was charged with eluding police, operating while intoxicated, assaulting a peace officer, failure to obey a stop sign, speeding and driving on the wrong side of the highway.

The eluding police and assaulting a peace officer charges are felonies.

Buerger pled not guilty to all charges. A pre-trial conference is set for 9:30 a.m. March 9, with a jury trial scheduled for March 24.

Buerger is being held at the Clayton County Jail on $13,000 bond.
